These Terms of Use ("Terms") govern your use of the US Citizenship Test mobile application (the "App", "Application") and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Educational Purpose / No Government Affiliation

The Service is an independent, third-party educational tool designed to help users practice for the U.S. naturalization civics test.

IMPORTANT DISCLAIMERS:
  • NOT AFFILIATED WITH GOVERNMENT: The Service is NOT affiliated with, endorsed by, sponsored by, or connected to USCIS, the U.S. Department of Homeland Security, or any other government agency or entity.
  • NOT OFFICIAL: This is NOT an official government application. It is a privately developed study aid.
  • Official resources: For official and authoritative information, always visit uscis.gov/citizenship.

2. No Guarantee of Results

THE SERVICE DOES NOT GUARANTEE THAT YOU WILL PASS THE U.S. CITIZENSHIP TEST, INTERVIEW, OR ANY IMMIGRATION PROCESS.
  • Your results depend entirely on your own preparation, knowledge, and performance during the actual test.
  • USCIS may change test questions, procedures, or requirements at any time without notice to us.
  • The Service Provider assumes no responsibility for the outcome of your citizenship application or test.
  • Use of this app does not create any relationship with USCIS or affect your immigration case in any way.

3. Content Accuracy and User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL INFORMATION WITH OFFICIAL USCIS SOURCES BEFORE YOUR TEST.
  • Content may be outdated: Test questions, answers, and related information in the app may become outdated as USCIS updates its materials. We make reasonable efforts to keep content current, but we do not guarantee accuracy or timeliness.
  • Elected officials change: Information about elected officials may be outdated due to elections, appointments, resignations, or deaths. Always verify current officials through official government sources before your test.
  • User's duty to verify: It is YOUR responsibility to check the official USCIS website for the most current test content before your interview.
  • No liability for outdated content: The Service Provider is not liable for any consequences resulting from outdated, inaccurate, or incomplete information in the app.

4. No Legal Advice

The Service provides general educational information and practice tools. It does not provide legal advice and does not replace guidance from USCIS, immigration attorneys, legal professionals, or accredited representatives. For legal questions about your immigration case, consult a qualified professional.

5. Eligibility

  • United States: You must be at least 13 years old.
  • EEA, UK, and Switzerland: You must be at least 16 years old (or the applicable age of digital consent in your country).
  • Other jurisdictions: You must meet the minimum age required by local law.

6. Subscription, Billing, and Cancellation

The App offers an optional premium subscription ("Pro") that removes advertisements and unlocks AI-powered features. All subscription transactions are processed entirely by Apple (App Store) or Google (Google Play).

  • Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • Cancellation: You can cancel anytime through your device's subscription settings. After cancellation, you retain access until the end of the current paid period.
  • Refunds: All refund requests must be submitted to Apple or Google. We cannot process refunds directly.
  • EU Right of Withdrawal: EEA users have a 14-day right of withdrawal for digital purchases. By using the subscription immediately, you acknowledge that you lose this right once the digital content has been fully provided.
  • Restore Purchases: Use the "Restore Purchases" feature if you reinstall the app or switch devices.

7. AI-Powered Features

The premium subscription includes AI-powered features that use third-party AI services (OpenAI). By using these features, you acknowledge:

  • Usage limits: AI features are subject to a daily session limit (currently 5 sessions per day). This limit may be changed at any time at our sole discretion.
  • Audio processing: Your spoken audio is sent to our server and forwarded to OpenAI for transcription. Audio is processed in real time and is not stored after transcription.
  • AI accuracy: AI transcription and evaluation are not perfect. Results may contain errors. You should not rely solely on AI evaluation to gauge your readiness for the actual test.
  • No guarantee of availability: AI features depend on third-party services that may experience outages or discontinuation. We do not guarantee any specific level of uptime or availability for AI features.
  • Service modification: We reserve the right to modify, suspend, or discontinue any AI-powered feature at any time, with or without notice.
  • Acceptable use: You agree not to use AI features for any purpose other than personal citizenship test preparation.

8. License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial use. You agree NOT to reverse engineer, modify, distribute, or interfere with the Service.

9. Intellectual Property

The Service and its original content (excluding public-domain government materials) are owned by the Service Provider and protected by applicable intellectual property laws. USCIS materials and other government content remain the property of their respective owners and may be subject to public-domain rules.

10. Third-Party Services

The Service relies on third-party services including RevenueCat (subscriptions), Google AdMob (advertising), Apple/Google (payments), government APIs (elected officials), OpenAI (AI features), and Supabase (backend). We are not responsible for the availability, accuracy, or content of any third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: The Service Provider shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages. Our total cumulative liability shall not exceed the greater of: (i) the amount you paid for the Service in the 12 months preceding the claim, or (ii) $10.00 USD.

13. Dispute Resolution

For Users Outside the EEA, UK, and Switzerland

Any dispute shall be resolved by binding arbitration, not in court (except small claims). You waive any right to participate in a class action. You may opt out by emailing sendfeedbackus@gmail.com within 30 days of first using the Service.

For Users in the EEA, UK, and Switzerland

The arbitration provisions above do not apply to you. You retain your right to bring any dispute before the competent courts. You may also use the EU Online Dispute Resolution platform.

14. Governing Law

These Terms shall be governed by the laws of the State of California, United States. For EEA/UK/Switzerland users, this does not deprive you of the protection of mandatory consumer protection provisions of your country of residence.

15. Termination

We may suspend or terminate your access at any time if you violate these Terms. You may stop using the Service at any time by uninstalling the App. You can delete your server-side data through "Delete My Data" in Settings. See our Privacy Policy for full details.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app. Your continued use of the Service means you accept the updated Terms.
